Use AIPLA’s Web Tool to Urge the Senate to Confirm David Kappos NOW as Director of the US PTO

This is an American Intellectual Property Law Ass’n (AIPLA) Action Alert: Help Confirm David Kappos as Director of the U.S. Patent and Trademark Office

“As an IP professional, you know that we need consistent and stable leadership at the USPTO.  The Senate Judiciary Committee is set to consider the nomination tomorrow and the entire U.S. Senate will hopefully be voting on David Kappos’ nomination as the next USPTO Director this week, but they may not.  We’re reaching out to you to contact your Senator to urge the Senate to vote THIS WEEK on the nomination before they recess for the summer.

“We’re also using our new grassroots advocacy tool for the first time to reach out to you and ask you to participate in this important appointment process.  We’ll likely come back to you in the near future, when we need your help communicating with Congress on other issues, such as patent reform.  This service, powered by CapWiz [, makes it easy for you to communicate with your representatives in Congress on important issues facing the IP profession.
We urge you to reach out today and voice your support for having the Senate vote THIS WEEK to approve Dave Kappos’ nomination.  The IP system can’t afford to wait another month!”

It’s been reported that today’s session of the U.S. Senate won’t have any roll-call votes. Some tweeters are wondering if that means that the Kappos confirmation won’t come until September. But I’m hoping that the matter gets to the floor today and that the YEA’s will drown out any NAY’s regarding the appointment of David Kappos as head of the US PTO.

Yesterday, the Republicans got to put on a debate until 3 PM about the nomination of Sonia Sotomayor as Associate Justice of the Supreme Court, and then the Senate did a roll-call. But for below-Cabinet-level appointments such as the PTO Director, I hear that the Senate generally goes along with actions of the Judiciary Committee. So I’m holding my breath today, anticipating a favorable result on Kappos.

Today the Senate Judiciary Committee approved his appointment and referred it to the Senate Floor. It is on the calendar for tomorrow, Friday, August 7th. The Lord willin’ and the creek don’t rise, we’ll have a new PTO Director before the August recess of the Senate.
